Just to further this a little I have been informed by one of the members of this forum that there is a lot of negative posts and warnings about me that I am a "scammer"" someone that can not be trusted " etc...
I will not be responding to any of these kind of accusations, as they do nothing but harm to both parties and there are no positives that ever come out of it. I believe that those that know me either by the forums I am on or those that have met me or have done bought or sold or helped ship stuff to me are the people that matter and know me well enough to make up their own mind.
I could go and post something to defend myself like all the email conversations and photos that has been sent but again this will not give him the outcome he is wanting.
Again thank you to everyone for your support, advice and friendship.
 
The muppet signed for a bonnet protector. Did he think he was getting a bonnet protector sized head?

It was a sunvisor I believe, and from the previous post by the buyer in this thread it does not seem like he believes or is accusing Christine of sending anything other than what she was meant to, rather that TNT has stuffed up in one way or the other, or has that changed?

There are a couple of other elements to this situation that he has either forgotten about or has not been able to see some of the flaws in this...
In one of the emails I sent out to him was to ask if he could forward me a picture of the package that he received. I also asked for details on any TNT stickers on it, the package was void of any TNT stickers labels etc.
question; how does a parcel travel from WA to NSW workshop with no stickers etc on it ?
The stickers and labels that TNT put on the parcels are to help with identifying them and used for tracking purposes.
Question: how does the TNT delivery driver know that he is delivering the right package to the right location?
The barcodes on the parcels get scanned by the drivers to confirm that delivery has been completed. This goes for each stage of transport.
 
loooool knew it was a dodgy from my first post. funny how he was so quick to defend himself.
 
That would of come from me... As I had said to him that I was posting on a few of the forums to see if anyone had seen or heard of someone suddenly finding a bargain of a deal with a ported head and cam... Or if someone spotted one for sale... Luckily I do know of something with this head to help identify it.... Which obviously I won't divulge about on a open forum.

I could if I wanted to make up another head for this guy and send it to him but... I feel that he would turn it into something else... Plus I'm not sure if I really have the time to do this.
 
Sorry to hear Christine about all the trouble this has become.

I have heard that the legal onus is on the seller to provide insurance and a refund if the product is not received or not as described.

How ever the buyer must provide proof to the seller he's not a dodgy trying to scam a seller.

Tough call :(

Except that onus is transferred to the freight company as soon as you hand it over. And if the buyer wanted insurance they would need to pay extra shipping costs for reimbursement purposes. I always offer people insurance when I send delicate things, if they refuse then I don't take responsibility for any damages. If you don't offer insurance, damage during transit is the seller's responsibility. If there is insurance, it's on the company. But assuming you sort that out and everything is peachy when you send it, the company takes 100% responsibility. Christine has been going above and beyond for this guy when she could have just sat on her ass and said "take it up with TNT, not my problem".
 
This whole situation does not sit well with me... I have looked at this from so many angles I really do wish he had the item I dont need this sort of thing to be added to the car community I think car enthusiasts have enough problems as it is... I believe I acted fulfilled my roll to the very best of my ability and followed all instructions as given in a lawful manner he requested a part, we negotiated a price which included postage/freight, he paid for the part as requested, I organised freight, packaged it securely and sent I forwarded him the delivery notes and consignment paper work to verify that I had organised this and that a date had been agreed for pick up.

The subject for insurance did not come up in conversation, however I think I looked at it and I have a feeling that I could not insure it because of the value of the item it came under a certain value.... not 100% sure on that...

He can try to pursue this further in a legal manner but like I had said previously to this I dont think it will stand up due to the nature of the package he received (showed in photos) minus documentation and that they had signed a legal document stating that they had received it.

Yes he had his apprentice receive the goods but his apprentice whilst being paid by him is considered a servant and has been given permission to act on his behalf.

It is not the fault of the apprentice he may be a 16 year old kid that has been asked to sign here and he has done so not thinking or realising he had better check what he was signing for, however it is interesting to hear what the apprentice did say to his employer, first story went along the lines of no he did not sign - then a few days later I came up with a photocopy of the reciept with his signature, then he said to his boss that the driver had made the statement that this did not look like a Cylinder head ( but he still signed for it) and he agreed it did not look like what was described on the paperwork. - interesting thing about this is that TNT have said to me unequivocally that there is no possible way for their drivers to know what is in the packages as it is not on the paperwork.

So as you can see I am unsure as to what is really going on here - just too many stories

Moral of the story is payment on pickup,
 
All im gona say is ive sold a variety of stuff to people out of state, and each time before i post i send detailed pics of the package showing how its securely wrapped, and properly addressed.
Saves your own ass
 
I work with alot of freight and have seen many similar things happen. Freight companys will never admit they are the ones that made the mistake.
 
I deal with TNT daily at work.
If the box doesn't come with TNT consignment documents and packing receipts, I don't sign for it.

That stuff is stuck on the side of every single package we ship and receive, if its not there, its not a box that has gone through TNT processing, and it isn't to be trusted.

The takeaway here is, if the receiver didn't have any TNT documentation on the package when the delivery driver delivered it...then how on earth could the driver have known to deliver it to that location in the first place?

Sounds to me like the driver is at fault here, cant see how they could deliver a package without labels.
 
This morning I have received another threatening email.... Again.

This time I have replied to him this time I have spelt out the obvious to him I am hoping that he reads it and takes on board what I have said, also said it is fine if he wants to continue down this path using social media etc, but it is not just me that he is making look bad he is also making himself and his business look very unprofessional....

I have also invited him to take this further in a legal manner if he wishes to go to the police or use the fair trading people I'm not fussed in fact I would welcome it, but I can't do it he has to put in the complaint himself as he was the one that has been disadvantaged.

Shame really he seemed like a nice guy.
 
I'd say you have been going well and truly above and beyond your responsibility because you a)want to find the part (b) want to do the right thing and (c) want to keep a good name in the car community. Has the other party done any digging at their end or just hassled you to do it all?

If they have signed for something that is clearly not what you sent then you did everything within your power to make sure it got to them. It is up to them and TNT to work out now. Yes, it sucks for them but you have paperwork and photos of evidence that it left your end through TNT. Tell them to politely get *fudge*ed and have them dig and take it up with TNT. Can you PM me the business so i can avoid them?

So who is not telling the truth? This is a copy of an email sent to Christine Howe and it states that the item that was picked up in WA didn't match the con note and then she accuses me of all sorts of *poo* like my apprentice or the local courier had something to do with the swap, I have those emails as well. To cut a long story short I have been ripped off and was only seeking a refund so you can understand why I'm pissed off paying $500 for a sunvisor. The facts are I was away when the part was delivered and didn't sign for it and it was the apprentice and because we get so many parts delivered he didn't check till he opened it and realised that it wasn't the head. I have been shipping and receiving parts for over 18 years and something like this has never happened so something fishy is going on. Christine should check if she has enemies because someone has done the swap in WA before it ever made it to NSW. End of story.

Please be advised TNT have spoken with their driver and he advised the box had the original connote placed on and the drivers do not change labels of freight. There has been a check through the unidentified register and there is no match for the missing item.

Additionally, we have been advised that they confirmation of the weight declared once the freight was collected was 5.95 kg opposed to the one you made on the booking which was 12kg. Please refer to the below screenshot:

It is only evident the wrong freight may have been sent as TNT would normally have some information regarding a parcel that may have been mis-sorted but all the information matches back to the collection.
